Lagos Assembly moves to raise magistrates’ retirement age to 65

The Lagos State House of Assembly has commenced moves to increase the mandatory retirement age of magistrates in the state from 60 to 65 years.

The proposed amendment is aimed at retaining experienced judicial officers and strengthening the administration of justice in Lagos State.

The development was reported as lawmakers considered a bill seeking to amend the existing legislation governing the retirement age and conditions of service of magistrates in the state.

Under the current arrangement, magistrates are required to retire from active service upon attaining the prescribed retirement age. The proposed amendment, if passed into law, would give qualified magistrates an additional five years in service.

Supporters of the proposed change are expected to argue that extending the retirement age would enable the judiciary to benefit from the experience and expertise of senior magistrates, particularly at a time when the justice system continues to face a growing workload.

Experienced magistrates play important roles in the administration of justice, handling criminal and civil matters and contributing to the speedy resolution of cases at the lower levels of the judiciary.

The proposed extension could also help reduce the loss of institutional knowledge that occurs when experienced judicial officers retire, while allowing younger officers to benefit from the mentorship and professional experience of senior colleagues.

However, the bill will still have to pass through the necessary legislative stages before it can become law. These include consideration and debate by the lawmakers, possible public or stakeholder input, passage by the Assembly and eventual transmission to the governor for assent.

The move is therefore not yet a change in the retirement age, but rather a legislative proposal that could alter the existing provision if successfully enacted.

The Lagos State Government and relevant judicial authorities are expected to be involved in the implementation of any amendment that is eventually approved.

The proposal has also drawn attention to the broader question of judicial reforms in Lagos, including the need to improve working conditions, strengthen the capacity of courts and ensure that experienced judicial officers are retained where their expertise remains valuable.

If the bill is passed and signed into law, magistrates who would otherwise retire at 60 could potentially remain in active service until they attain 65, subject to the other requirements and provisions contained in the amended law.
